WHEREAS, the Privacy Policy of the Judicial Conference of the United States requires parties to redact Social Security numbers, financial account numbers, names of minor children, and dates of birth from records filed with the court; and WHEREAS, the case caption and pleadings submitted in a civil asset forfeiture action typically contain numerous references to the prohibited personal identifiers, making the redaction of every personal identifier a substantial administrative burden that may unnecessarily delay the resolution of the case. At Wilmington this 19th day of April, 2005, IT IS ORDERED THAT: 1. Electronic filings in asset forfeiture actions shall not be available to the general public by remote Internet access. 2. Pleadings in civil asset forfeiture cases shall be exempt from the Privacy Policy of the Judicial Conference of the United States, may be filed in an unredacted form, and shall be added to the public docket and made available in electronic or paper format to anyone who personally appears at the Clerk's Office. |
