      STANDING ORDER
  
  
           WHEREAS, in December 2006, a judicial vacancy resulted due to the elevation of the Honorable Kent A. Jordan to the Court of Appeals for the Third Circuit;
            WHEREAS, similar to previous judicial vacancies the Judges of the Court determined that the caseload of the Court's fourth judgeship, while vacant, was to remain intact for assignment to Judge Jordan's successor;
            WHEREAS, the Judges of the Court entered Orders dated December 15, 2006, and August 6, 2007, providing for the pretrial management of the caseload and assignment of new cases to the caseload;
            WHEREAS, because the vacancy in the fourth judgeship has existed for over one year and because it appears that the vacancy will continue for some time; the District Judges have met and determined that a modification of the assignment procedure and pretrial management of the caseload is necessary;
            THEREFORE, at Wilmington this 23rd day of January, 2008, pursuant to 28 U.S.C. § 137 and the rules of the Court IT IS ORDERED that:

Effective the date of this Order, the Order captioned "IN RE: ASSIGNMENT OF CIVIL CASES TO UNITED STATES MAGISTRATE JUDGES" which was made effective on the 6th day of August, 2007 except paragraph 3 of said 
Order, is hereby rescinded.
The cases assigned to the vacant judgeship prior to August 6, 2007, all cases assigned pursuant to the Order of August 6, 2007, and all cases filed in the future in the District shall, until further notice, be divided among the three active District Judges in accordance with the method currently employed by the Court for the allocation of assignments.
This Order shall be effective January 23, 2008.
