Criminal Debt

  • Defendants

Payment: Remit all payments towards criminal debt with cash in person or via check/money order with the payee “Clerk, United States District Court” to

Please ensure that the FRONT of the check/money order is signed. If you endorse the back, your remittance will be sent back to you.

Please note that credit cards or debit card payments are NOT permitted for criminal debt.

Interest/Penalties: DOJ is responsible for calculating the interest and penalties assessed on restitution. Contact the US Attorney’s Office Financial Litigation Program for your assessment at (302) 573-6277.

Bounced Checks/Insufficient Funds: If your payment is returned to the Court as an Insufficient Funds item (NSF), please note that your account will be debited the amount of the remittance, and you will be assessed a $53 administrative fee for the NSF. You will also be no longer permitted to remit personal checks- money orders and cashier’s checks only.

Satisfaction of Judgments/ Release of Liens: The Clerk’s Office does not issue Satisfaction of Judgments for cases. If you believe you’ve successfully paid all your liability and would like a Satisfaction of Judgment in your case, contact the US Attorney’s Office Financial Litigation Program.

Address Updates: Defendants are responsible for updating their address with the US Attorney’s Office appropriately. Please note that the USAO issues payment stubs, not the Clerk’s Office.

 

  • Victims

Victims are responsible for notifying the USAO and the court of any change in their mailing address while restitution is still owed to the victim. See:  18 U.S.C. § 3612(b)(1)(G). The Clerk’s Office cannot provide information regarding defendant payment schedules.

(a)Victim Address Change

Submit an Form AO 140 (Victim Address Change Form) to the Court to facilitate an address change.

(b)Victim Name Changes

Victim name changes are overseen and submitted by the US Attorney’s Office ((302) 573-6277). All payee name changes must be approved by court order.

Exception:  When the FDIC is named as the receiver for a failed bank or financial institution, the FDIC succeeds by operation of law, and no judicial determination to change the name of the victim is required.  See:  12 U.S.C. § 1821(d)(2)(B)

(c) Deceased Victims

Any restitution payment, made payable to the deceased victim, must be made by Treasury check (not EFT).  An executor/executrix or administrator of a payee's estate, appointed under applicable state law, may negotiate the check.

A court order is required to redirect future disbursements of restitution, please contact the US Attorney’s Office if you need a victim name change.
