Passports

The Clerk’s Office cannot accept or release passports without a Court Order.

When surrendering your passport:

You need an order (usually an Order Setting Conditions of Release). If the defendant will be surrendering the passport themselves, please ensure that you have a copy of the order and a copy of the PS40 form provided by Probation before coming to the Clerk’s Office.

 

When retrieving your passport:

If you are convicted:

Your passport will be transferred to the Department of State (U.S. Department of State CA/PPT/S/A 44132 Mercure Circle P.O. Box 1243 Sterling, VA 20166-1243).

If you are not convicted:

Contact US Probation & Pretrial Services (302-252-2950) to affirm that your passport can be retrieved. Please refrain from coming to retrieve your passport without scheduling an appointment by calling the Clerk’s Office (302-573-6170).

If your case is transferred to another district:

Your passport will be transferred to that district.
