Appointment Forms for Transfer-In Employees: Clerk's Office

Below you will find details regarding your transfer without a break in service to the District Court of Delaware. Please review the information carefully and submit the necessary information prior to your transfer date. If you have any questions, please don’t hesitate to contact Beth Mason.

1. Contact Information- Human Resources- REQUIRED
Please provide Beth Mason with the following information so the District Court of Delaware can begin to process your transfer: name, phone number and email address of the Human Resources contact at the Court you will be transferring out from.

2. Application For Judicial Branch Federal Employment (A0‐78)- REQUIRED
Complete this form accurately and entirely, as it is an important record of prior experience used to determine your qualifications and may be used in future consideration of opportunities for advancement. Under the Work Experience section, please make sure to list the separation date from the current Federal Agency you are employed by.
 

3. Voluntary Race/Ethnicity, Gender, & Disability Identification (AO-78B)- OPTIONAL
You are requested to provide this information to aid the federal judiciary in reporting on equal employment opportunities. This information will be used in planning and monitoring fair employment practices programs. Providing this information is voluntary.
 

4. Tax Forms
*IMPORTANT NOTICE* The address entered on the W-4 is the “address of record” used for mailing the W-2 at the end of the year. If an out of state address is listed on the W-4, withholdings for that state may apply.

Federal W-4: All employees must complete the W-4 Employee's Withholding Certificate form. 

State of Delaware taxes: Will be withheld from your pay regardless of state of residence. Delaware does not have a reciprocal agreement with Pennsylvania, New Jersey or Maryland. All employees must complete a "State of Delaware W-4" form. 

City of Wilmington Tax: Will be deducted at a rate of 1.25%.

Residency Certification Form (PENNSYLVANIA RESIDENTS ONLY):
Per the Payroll Services Branch at the Administrative Office, Pennsylvania residents are required to complete a Residency Certification Form. Please fill in your mailing address, social security number, work address and sign/date the form. The Payroll Services Branch will complete the Resident PSD and Total Resident EIT Rate sections based on your municipality.

New Jersey residents ONLY: All residents of New Jersey are required to complete a NJ-W4 form.
Maryland residents ONLY: All residents of Maryland are required to complete an MW-507 form. 

5. DISTRICT COURT ONLY: Please complete the "Emergency Information" form and return to Elizabeth_Mason@ded.uscourts.gov. This information will be used to set up an account for you on the Judiciary's Infoweb so you can be contacted in the event of an emergency. 
 

6. Background Check- REQUIRED
As a condition of employment, background checks or investigations are mandatory for all transfers without a break in service. Please note that the position for which you have applied is considered a sensitive position. If selected, you will be hired provisionally pending the outcome of the background check. The background check is an FBI Fingerprint Check of criminal history records. Human Resources will coordinate the processing of your fingerprints either prior to your start date or on your start date. Please complete the Fingerprint Demographic Information Form and return to Elizabeth_Mason@ded.uscourts.gov. In addition to your FBI background check or investigation, the District Court of Delaware also requires all employees complete an NCIC background check prior to receiving the results of the FBI background check or investigation. Please complete the Consent to Criminal Records Check and return to Elizabeth_Mason@ded.uscourts.gov
 

7. IT Appropriate Use and Security Policy & Agreement- REQUIRED
Please read the Information Technology Use Policy and return a signed copy to Elizabeth_Mason@ded.uscourts.gov.
 

8. Transit Subsidy Agreement/Commuter Benefits- OPTIONAL
The Transit Subsidy Program is available to permanent employees of the Clerk’s Office. Please read the Transit Subsidy Agreement for program details. If you wish to participate in the Transit Subsidy Program, please return the signed agreement to Beth Mason. If you will be selecting parking, there are several options:

• Customs House Garage/DoubleTree Hotel
• Alico Building (contact Wilmington Parking Authority for rates and availability)
• Government Center Garage
• 9th and French Street (contact Colonial Parking for rates and availability)

Parking reimbursement will occur on a quarterly basis in January, April, July and October. Please provide the Finance Department your parking receipts at the end of each quarter on the following dates: 9/23- 9/30, 12/23- 12/31, 3/23- 3/31, 6/23- 6/30. In the event you will be changing your Transit Subsidy Election during your employment, please complete a new Transit Subsidy Election form and submit to Beth Mason.

In conjunction with the Federal Transit Subsidy Program, you can also sign up for the Commuter Benefits Program. This is designed to assist employees in defraying the additional costs of parking expenses. The account allows you to set aside part of your salary on a pre-tax basis. This means your monthly contributions are deducted from your salary before taxes are deducted, thereby increasing your spendable income. For more information, please see the Commuter Benefit FAQ's. You can enroll or make changes at any time. Please note, if you enroll in the Commuter Benefit Program, you can only elect the amount over the $100 transit subsidy. Per the A.O., you are not permitted to claim the $100 Transit Subsidy amount, only the difference between the $100 and what your monthly parking is.

Please note that you can not enroll in the commuter parking benefit program prior to your start date. The Administrative Office needs to process your appointment paperwork and set you up as a new employee first, which generally takes 2-3 weeks from your start date. After that, you can enroll through the Judiciary Benefits Center website.

9. Fitness Center- OPTIONAL
The Fitness Center is located on the third floor in room 3124. The Fitness Center has the following equipment: two treadmills, one elliptical, two recumbent bikes, free weights and a Smith machine. The Fitness Center is available to employees who sign the Informed Consent Agreement and the Fitness Center Rules . Please sign the forms and return to the Clerk’s Office staff in room 4209. Upon receipt of the forms, Intake Supervisor Robert Cruikshank will provide you with an access code to the Fitness Center.

10. Provisional Appointment Form (HIGH-SENSITIVE EMPLOYEES ONLY)
